STANDARD TERMS & CONDITION

These Terms & Conditions set out the basis on which Limitless Boilers Ltd provides plumbing, heating, boiler and related services to its customers.

They are intended to make our services, pricing, responsibilities and guarantees clear and transparent while protecting both the Customer and Limitless Boilers Ltd.

Nothing in these Terms & Conditions affects any statutory rights that a consumer may have.

1. GENERAL TERMS
1.1 About These Terms

These Terms & Conditions apply to all quotations, estimates, bookings, repairs, installations, maintenance services and other works carried out or materials supplied by Limitless Boilers Ltd ("Limitless Boilers", "we", "us" or "our").

By accepting a quotation, making a booking, instructing us to carry out work, paying a deposit or allowing our engineer to commence the Works, the Customer agrees to these Terms & Conditions.

1.2 Definitions

The Company means Limitless Boilers Ltd.

The Customer means the person, homeowner, landlord, tenant, business or other organisation instructing the Company to carry out Works or supply materials.

The Engineer means the engineer or other suitably qualified person appointed by the Company to carry out the Works.

The Works means the plumbing, heating, boiler, gas, installation, repair, maintenance, servicing or other services agreed with the Customer.

Materials means appliances, parts, components, equipment and other goods supplied by the Company as part of the Works.

1.3 Our Services

Our services may include, but are not limited to:

  • Boiler installations and replacements

  • Boiler servicing

  • Boiler repairs and fault diagnosis

  • Central heating installation and repairs

  • Radiator installation and repairs

  • Powerflushing and heating system cleaning

  • Hot water cylinder and unvented cylinder installations

  • Megaflo and associated hot water system services

  • Smart thermostat installations

  • Water softener installations

  • Plumbing repairs and installations

  • Emergency plumbing services

  • Water leak repairs

  • Pumps, valves and controls

  • General heating and plumbing works

The exact Works to be carried out will depend on the Customer's requirements and the quotation, estimate, booking or other agreement provided.

1.4 Right to Decline or Stop Work

We reserve the right to refuse, decline or stop Works where we reasonably believe that:

  • The work is unsafe;

  • The installation is unsuitable for the requested work;

  • The work is outside our expertise or qualifications;

  • The property or working environment presents a significant health and safety risk;

  • Continuing the Works would result in an unsafe installation;

  • Required access or working conditions have not been provided; or

  • The Customer behaves in an abusive, threatening or otherwise unacceptable manner towards our staff or engineers.

Where possible, we will explain the reason for refusing or stopping the Works and advise the Customer of any appropriate next steps.

2. QUOTATIONS, ESTIMATES & PRICING
2.1 Quotations

Where a fixed-price quotation is provided, the quotation applies only to the Works and scope specifically described within it.

Unless expressly stated otherwise, a quotation does not include additional works, hidden defects, remedial works, replacement of existing components or building and decorative works outside the agreed scope.

2.2 Quote Validity

Unless otherwise stated on the quotation, formal written quotations are valid for 14 days from the date of issue.

Where a project has not commenced within 90 days due to Customer delay, we reserve the right to review and, where necessary, adjust the quoted price to reflect changes in material, equipment, labour or supplier costs.

Any revised price will be communicated to the Customer before the additional cost is incurred.

2.3 Estimates

Where we provide an estimate rather than a fixed-price quotation, the estimated price or labour time is an approximation only.

For diagnostic and repair work, the final charge may reflect the actual time reasonably required to diagnose and complete the agreed Works, together with applicable parts and materials.

An estimate is not a fixed-price quotation unless expressly stated to be so.

2.4 Hourly-Rate Work

Where Works are charged on an hourly basis, the Customer will be charged according to our applicable labour rate for the time reasonably spent carrying out the Customer's Works.

Chargeable time may include reasonable time spent:

  • Diagnosing faults;

  • Carrying out repairs;

  • Testing and commissioning;

  • Obtaining necessary parts;

  • Completing relevant job documentation; and

  • Carrying out other work reasonably connected with the Customer's booking.

We will endeavour to keep additional time and costs reasonable.

2.5 Additional and Unforeseen Work

Additional work may become necessary where:

  • The Customer requests work outside the original scope;

  • Hidden or inaccessible defects are discovered;

  • The actual condition of the installation differs materially from what was reasonably anticipated;

  • Additional parts or materials are required;

  • Work is required to address a safety issue;

  • The original quotation contained an obvious error or omission; or

  • A manufacturer or supplier changes the availability or specification of a required product.

Where reasonably possible, we will explain the additional work and obtain the Customer's approval before proceeding.

Where immediate action is reasonably necessary to make a situation safe or prevent serious damage, we may take proportionate action before obtaining further approval.

2.6 Fixed-Price Work

A fixed price applies only to the agreed scope of Works.

Additional works or materials outside that scope will be chargeable separately where approved by the Customer.

3. BOOKINGS, APPOINTMENTS & CANCELLATIONS
3.1 Booking Confirmation

A booking is confirmed once the Customer has accepted the appointment and any required deposit or booking payment has been received.

Appointment times may be provided as a specific time or an estimated arrival window.

3.2 Appointment Times

We will use reasonable endeavours to attend at the agreed date and time or within the agreed appointment window.

Occasionally, circumstances outside our reasonable control may result in a delay.

Where possible, we will notify the Customer of significant delays and endeavour to rearrange the appointment where necessary.

3.3 Cancellation or Rescheduling

Customers should provide at least 48 hours' notice where they need to cancel or reschedule an appointment.

We understand that genuine emergencies can occur and will consider the circumstances of individual cancellations reasonably.

3.4 Late Cancellation Charge

Where an appointment is cancelled or rescheduled with less than 48 hours' notice, a cancellation charge may apply.

The minimum charge will be equivalent to one hour of our standard labour rate.

This charge reflects the engineer's time and availability reserved specifically for the appointment and the potential loss of an opportunity to attend another customer.

3.5 No Access or Aborted Visits

If our engineer attends the agreed property but cannot gain access, or cannot reasonably carry out the booked Works because the Customer has not provided the required access or working conditions, the appointment may be treated as an aborted visit.

A minimum charge equivalent to one hour of our standard labour rate may apply.

Any additional reasonable costs incurred specifically as a result of the aborted visit may also be chargeable.

3.6 Emergency and Priority Appointments

Where an emergency or priority appointment has been specifically arranged, different attendance arrangements or charges may apply. These will be communicated to the Customer at the time of booking where applicable.

3.7 Consumer Cancellation Rights

Nothing in these cancellation provisions removes or limits any statutory cancellation rights that may apply to a consumer.

Where applicable, the Customer will be provided with the information required by law regarding cancellation rights.

4. PAYMENT & DEPOSITS
4.1 Payment for Completed Work

Unless otherwise agreed in writing, payment is due immediately upon completion of the Works and presentation of the invoice.

For repair, servicing, maintenance and other works completed during a single visit, payment is due at the end of the appointment unless alternative payment terms have been agreed in advance.

4.2 Deposits for Larger Projects

For boiler installations, bathroom renovations and other projects with a total quoted value exceeding £500, a deposit of 50% of the quoted price must be paid and cleared before materials are ordered or work commences.

The remaining balance will be due in accordance with the payment schedule stated in the quotation or, where no alternative arrangement has been agreed, upon completion of the Works.

4.3 Special-Order Materials

Where materials, appliances or components are specially ordered for a Customer's project, we may require payment for those items before placing the order.

Where such items are bespoke, specially manufactured or non-returnable, the Customer may be responsible for reasonable costs incurred if the order is subsequently cancelled, subject to applicable law.

4.4 Overdue Payments

Where an invoice remains unpaid after the due date, Limitless Boilers reserves the right to charge interest at a rate of 6% above the Bank of England base rate per annum, calculated daily from the due date until payment is received in full, where legally applicable.

We may also seek to recover reasonable costs associated with recovering overdue sums where permitted by law.

4.5 Disputed Invoices

If the Customer believes that an invoice contains an error or wishes to raise a genuine dispute, they should contact us as soon as reasonably possible and explain the basis of the dispute.

Undisputed amounts remain payable in accordance with these Terms & Conditions.

5. CUSTOMER RESPONSIBILITIES & ACCESS
5.1 Access to the Property

The Customer is responsible for providing reasonable access to the property and to the appliance, heating system, plumbing installation, boiler, cylinder, controls, loft space, airing cupboard or other areas reasonably required to carry out the Works.

5.2 Working Environment

The Customer must provide a reasonably safe and accessible working environment.

The Customer should inform us of any known hazards, restrictions, asbestos or suspected asbestos, previous alterations or other circumstances that may affect the Works.

5.3 Clear Working Area

The Customer is responsible for moving furniture, personal belongings, carpets or other items where reasonably necessary to provide access to the area in which Works are to be carried out.

Where the Customer has not provided adequate access, additional labour or attendance costs may apply.

5.4 Parking and Access Restrictions

Where parking restrictions, permits, controlled parking zones, congestion charges or similar access requirements apply, the Customer should inform us in advance.

Reasonable costs incurred in attending the property may be chargeable where applicable.

5.5 Utilities

Where required to perform the Works safely, the Customer must provide reasonable access to available water, electricity and other utilities.

6. REPAIRS & FAULT DIAGNOSIS
6.1 Our Approach to Repairs

When you book Limitless Boilers to investigate a fault, our engineer will assess the appliance, plumbing or heating system and use their professional judgement to identify the likely cause of the problem.

Where reasonably possible, we will explain the fault, available repair options and likely cost before carrying out additional chargeable work.

6.2 Diagnosis Does Not Guarantee Future Performance

A diagnosis relates to the fault or faults that can reasonably be identified at the time of inspection.

Repairing one fault does not guarantee that an older boiler, heating system, plumbing installation or individual component will continue to operate without further faults.

This is particularly relevant to older appliances and systems where several components may be worn, corroded or approaching the end of their serviceable life.

A successful repair does not therefore constitute a guarantee of the overall condition, reliability or future lifespan of the appliance or system.

6.3 Repairs Within the Agreed Scope

Where the required repair can reasonably be completed within the agreed booking or quoted scope, we will aim to complete the repair during the visit, subject to parts availability and safe working conditions.

6.4 Additional Repairs

If additional work, parts or materials are required beyond the agreed scope, we will normally explain the requirement and provide a price or quotation before proceeding.

There is no obligation for the Customer to accept additional work unless immediate action is reasonably necessary to address a safety issue.

6.5 Beyond Economical Repair

A boiler, heating component or plumbing appliance may be considered beyond economical repair where:

  • The repair cost is disproportionate to the value or expected remaining service life;

  • Required parts are unavailable or obsolete;

  • The appliance has multiple significant faults;

  • The appliance or installation is unsafe; or

  • Further repairs are unlikely to provide a reliable or cost-effective solution.

Where appropriate, we may recommend replacement and provide a quotation.

The decision whether to repair or replace remains with the Customer, subject to applicable safety requirements.

6.6 Replacement Parts

We will endeavour to use suitable and compatible replacement parts.

Where an original part is unavailable or obsolete, we may recommend an appropriate alternative.

6.7 Parts Availability

Some repairs cannot be completed during the initial visit because parts need to be ordered.

We will make reasonable efforts to source the required parts and arrange a return visit as soon as reasonably practicable.

Delays caused by manufacturers or suppliers may be outside our control.

6.8 Existing Components and Pre-Existing Defects

Existing components may be old, corroded, seized, brittle or already defective.

We cannot accept responsibility for the failure of an existing component where the failure results from its pre-existing condition rather than defective workmanship by Limitless Boilers.

This may include existing:

  • Pipework;

  • Radiators;

  • Valves;

  • Pumps;

  • Controls;

  • Electrical components;

  • Cylinders;

  • Expansion vessels; and

  • Other components that we have not supplied or replaced.

6.9 Hidden Pipework, Wiring and Services

We will take reasonable care when working on existing installations.

However, where pipes, cables, wiring or other services are concealed and their location, condition or installation cannot reasonably be identified before work begins, we cannot guarantee that they can be avoided.

If an unexpected concealed service or obstruction is discovered, we may need to stop work and discuss the available options with the Customer.

6.10 Removed Parts

Unless the Customer specifically requests that removed parts or equipment are retained before they are removed, we may dispose of or recycle them as part of our normal waste-disposal procedures.

7. BOILER & HEATING INSTALLATIONS
7.1 Installation Scope

Boiler and heating installation quotations apply to the specific installation described in the quotation.

Unless expressly included, the quotation does not include unrelated remedial works, replacement of existing heating components, extensive building works, decorating, plastering, tiling, flooring, cabinetry or other making-good works.

7.2 Existing Heating Systems

Where an existing heating system is retained, we cannot guarantee the future performance or lifespan of components that we have not supplied or replaced.

A new boiler does not guarantee that existing radiators, valves, pipework, pumps, controls or other components will remain operational indefinitely.

7.3 Making Good

Unless specifically included in the quotation, our Works do not include:

  • Plastering;

  • Painting or decorating;

  • Tiling;

  • Flooring;

  • Carpentry;

  • Cabinetry;

  • Major building works; or

  • Extensive making-good works.

Where access requires removal or disturbance of existing finishes, we will take reasonable care but cannot guarantee that decorative finishes will be restored to their original condition unless specifically agreed.

7.4 Electrical and Other Specialist Works

Where specialist electrical, building or other works are required outside our agreed scope, these may be excluded from the quotation and may need to be carried out by an appropriately qualified third party.

8. POWERFLUSHING & SYSTEM CLEANING
8.1 Existing System Condition

Powerflushing and system cleaning involve circulating water and cleaning chemicals through an existing heating system.

Existing systems may contain old, weakened, corroded or damaged components.

8.2 Risk of Component Failure

The process may expose weaknesses in existing radiators, valves, pipework, pumps, heat exchangers or other components.

Previously weakened or corroded components may begin to leak or fail during or following the Works.

Where reasonably foreseeable, we will advise the Customer of relevant risks before commencing the work.

8.3 Additional Repairs

Where an existing component fails or requires replacement as a result of its pre-existing condition, the replacement or remedial work will be treated as additional work unless expressly included in the quotation.

8.4 System Performance

Powerflushing is intended to improve the condition and operation of a heating system but cannot guarantee the future performance or lifespan of individual components within an existing system.

9. GAS SAFETY & UNSAFE CONDITIONS
9.1 Gas Safety

Gas-related work will only be undertaken by an appropriately qualified Gas Safe registered engineer.

9.2 Unsafe Appliances or Installations

If an engineer identifies an unsafe appliance, flue, gas installation, ventilation arrangement or other dangerous condition, we may be required to stop or restrict the Works and take appropriate safety action.

This may include isolating or disconnecting an appliance where permitted or required.

9.3 Gas Warning Notices

Where appropriate, the Customer may be provided with relevant safety documentation or notification regarding an unsafe condition.

The Customer is responsible for addressing safety issues that they choose not to instruct us to remedy, subject to any legal obligations that may apply.

9.4 Refusal to Carry Out Unsafe Work

We will not be required to carry out or reconnect an appliance or installation where doing so would create an unsafe condition or breach applicable safety requirements.

10. CUSTOMER-SUPPLIED MATERIALS
10.1 Customer-Supplied Parts

We may, at our discretion, agree to install parts, appliances or materials supplied by the Customer.

We reserve the right to refuse to install a product that we reasonably believe is unsafe, unsuitable, incompatible or defective.

10.2 Responsibility for Customer-Supplied Materials

Where Customer-supplied materials are used:

  • We do not guarantee their suitability, quality or compatibility;

  • We are not responsible for manufacturer defects;

  • Additional labour may be chargeable where incorrect or unsuitable materials have been supplied; and

  • Our workmanship guarantee does not cover defects caused by unsuitable or defective Customer-supplied materials.

11. GUARANTEES & WARRANTIES
11.1 Workmanship Guarantee

Unless a different guarantee is expressly stated in writing, Limitless Boilers provides a 12-month workmanship guarantee from the date of completion of the relevant Works.

This guarantee applies to defects arising directly from our workmanship.

11.2 What the Workmanship Guarantee Covers

The workmanship guarantee covers faulty workmanship in the Works carried out by Limitless Boilers.

Where an issue is covered, we will reasonably investigate and, where appropriate, rectify the defective workmanship.

11.3 What the Workmanship Guarantee Does Not Cover

The workmanship guarantee does not cover:

  • Normal wear and tear;

  • Misuse or neglect;

  • Accidental damage;

  • Existing defects;

  • Manufacturer or product defects;

  • Customer-supplied materials;

  • Failures of existing components not supplied or replaced by us;

  • Blockages;

  • Problems caused by another contractor or third party;

  • Alterations or repairs carried out by another person;

  • Failure to follow reasonable operating or maintenance instructions;

  • External factors outside our reasonable control; or

  • Consequential or unrelated faults.

11.4 Manufacturer Warranties

Appliances, boilers, pumps, controls, cylinders and other products may be covered by a separate manufacturer's warranty.

The manufacturer's warranty applies according to the manufacturer's own terms and conditions.

The Company cannot extend, alter or guarantee a manufacturer's warranty unless expressly agreed in writing.

11.5 Third-Party Alterations

The workmanship guarantee may not apply where the relevant Works have subsequently been altered, repaired, modified or tampered with by the Customer or another contractor and the alteration has caused or contributed to the reported problem.

11.6 Existing Installations

Where we work on an existing installation, no guarantee is given regarding the overall condition, suitability or remaining lifespan of components that we have not supplied or replaced.

11.7 Making a Guarantee Claim

If you believe there is a defect in our workmanship, please contact us as soon as reasonably possible.

We may need to inspect the Works before determining whether the issue is covered by our workmanship guarantee.

12. OPPORTUNITY TO INSPECT & RECTIFY
12.1 Inspection

If the Customer believes that our Works have not been completed correctly, the Customer should contact us and provide a reasonable opportunity for us to inspect the relevant Works.

12.2 Remedial Work

Where the issue is found to be covered by our workmanship guarantee, we will take reasonable steps to rectify the issue.

12.3 Third-Party Remedial Work

Where reasonably possible, the Customer should contact Limitless Boilers before instructing another contractor to carry out remedial work relating to our Works.

This gives us a fair opportunity to investigate and, where appropriate, rectify the issue.

This provision does not affect the Customer's statutory rights or prevent emergency action where necessary to protect health, safety or property.

13. COMPLAINTS & AFTERCARE
13.1 Our Commitment

At Limitless Boilers, we aim to provide professional workmanship, honest advice and a high standard of customer service.

We understand that occasionally something may not go as expected.

If you are unhappy with any aspect of our service or the Works carried out, please contact us so that we have the opportunity to understand the issue and put matters right where appropriate.

All complaints will be treated seriously, fairly and respectfully.

13.2 How to Make a Complaint

To help us investigate the matter efficiently, please provide:

  • Your name;

  • Property address;

  • Date the Works were carried out;

  • Invoice or job reference, where available;

  • A clear description of the issue; and

  • Photographs or other supporting information where appropriate.

13.3 Acknowledgement

We will acknowledge receipt of a written complaint as soon as reasonably practicable.

We may contact you for additional information where necessary.

13.4 Investigation

We may review:

  • The original booking;

  • Quotation or estimate;

  • Job notes;

  • Engineer reports;

  • Photographs;

  • Parts and materials supplied;

  • Invoices;

  • Recommendations made during the visit; and

  • Relevant communications.

Where necessary, we may arrange an inspection.

13.5 Opportunity to Put Matters Right

Where appropriate, we will provide a reasonable opportunity to inspect the Works and, where we are responsible for the issue, take reasonable steps to rectify it.

Customers should contact Limitless Boilers before instructing another contractor to carry out remedial work relating to our Works wherever reasonably possible.

13.6 Manufacturer or Third-Party Issues

Some complaints may involve manufacturers, suppliers, warranty providers, another contractor or another third party.

Where this occurs, we may need to obtain information from the relevant third party before reaching a conclusion.

We will keep the Customer reasonably informed where this is likely to delay the investigation.

13.7 Resolution

Our aim is to resolve complaints as quickly and fairly as reasonably possible.

Where a complaint relates to our workmanship, we will take appropriate steps to remedy the issue where it is covered by the applicable guarantee.

Where an issue is found to be unrelated to our Works or outside our responsibility, we will explain the reasons for our decision as clearly as reasonably possible.

13.8 Escalation

If the Customer remains dissatisfied following our investigation, they should contact us and explain the reasons for their continued concern.

We will review the matter further where appropriate.

Nothing in this complaints procedure limits or removes any statutory rights available to the Customer.

14. PRE-EXISTING CONDITIONS & PROPERTY DAMAGE
14.1 Existing System Weaknesses

Existing plumbing and heating systems may contain components that are degraded, corroded, poorly installed or approaching the end of their serviceable life.

We cannot accept responsibility for failures that result from such pre-existing conditions rather than defective workmanship by Limitless Boilers.

14.2 Leaks and Component Failures

Leaks, burst pipes or component failures may occur when existing systems are drained, refilled, pressure tested, powerflushed, repaired or otherwise disturbed.

Where the failure results from the pre-existing condition of the component rather than our negligence or defective workmanship, the resulting repair will be treated as additional work.

14.3 Damage to Fragile Finishes

We will take reasonable care when working within the Customer's property.

However, old, fragile or deteriorated finishes and components may be susceptible to damage when necessary access is required.

Unless specifically included in the quotation, we are not responsible for reinstating decorative finishes such as:

  • Painting;

  • Plaster;

  • Tiles;

  • Carpets;

  • Flooring;

  • Wallpaper; or

  • Other decorative finishes.

15. DELAYS & CIRCUMSTANCES BEYOND OUR CONTROL
15.1 Delays

We will use reasonable endeavours to complete Works within agreed timescales.

However, we are not responsible for delays caused by circumstances beyond our reasonable control.

These may include:

  • Severe weather;

  • Traffic or road closures;

  • Supplier or manufacturer delays;

  • Parts shortages;

  • Utility failures;

  • Emergencies;

  • Unexpected defects;

  • Access problems;

  • Regulatory requirements;

  • Industrial action; or

  • Other events outside our reasonable control.

15.2 Rearranging Appointments

Where a delay prevents us from attending or completing Works as planned, we will endeavour to inform the Customer and rearrange the appointment as soon as reasonably practicable.

16. LIABILITY
16.1 General Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

16.2 Consequential or Unrelated Loss

Subject to applicable law, we will not be responsible for losses that are not reasonably foreseeable or that are unrelated to the Works we have agreed to undertake.

16.3 Customer's Statutory Rights

Where the Customer is a consumer, nothing in these Terms & Conditions limits or removes statutory rights available to the Customer.

17. RETENTION OF TITLE
17.1 Ownership of Unpaid Goods

Where goods or materials are supplied by Limitless Boilers Ltd and remain unpaid for, ownership of those goods will remain with Limitless Boilers Ltd until payment has been received in full, to the extent permitted by law.

This provision does not affect any statutory rights the Customer may have.

18. RECOMMENDATIONS & ADDITIONAL WORK
18.1 Recommendations

During the course of the Works, we may identify additional defects, maintenance requirements or safety concerns.

Where appropriate, we will explain these to the Customer and may record recommendations on the invoice, service report or other documentation.

18.2 Customer's Decision

The Customer may choose whether to proceed with recommended additional work, except where action is required to comply with applicable safety requirements.

Where a Customer chooses not to proceed with recommended work, we may explain the potential consequences.

Limitless Boilers cannot accept responsibility for a subsequent problem caused or contributed to by a known defect where the Customer has been advised of the issue and has chosen not to have the recommended remedial work carried out, subject always to applicable law.

19. CONSUMER CANCELLATION RIGHTS
19.1 Statutory Rights

Where the Customer is a consumer and the contract is entered into at a distance or away from our business premises, statutory cancellation rights may apply.

The Customer will be provided with the required cancellation information where applicable.

19.2 Request to Begin Work During Cancellation Period

Where applicable, if the Customer requests that Works begin during a statutory cancellation period, we may require the Customer's express request to begin the service before that period has expired.

19.3 Completed Services

Where the Customer has expressly requested that a service begin during the applicable cancellation period and the service has been fully performed, statutory cancellation rights may cease where the legal requirements for this have been satisfied.

20. CHANGES TO THESE TERMS
20.1 Changes

We may update these Terms & Conditions from time to time.

The version applicable to a particular contract will normally be the version in force and provided to the Customer when the contract was agreed.

Any changes to an existing contract must be agreed in accordance with applicable law.

21. SEVERABILITY

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision shall be modified or removed to the minimum extent necessary without affecting the validity of the remaining provisions.

22. GOVERNING LAW

These Terms & Conditions and any contract between Limitless Boilers Ltd and the Customer shall be governed by the laws of England and Wales.

Where the Customer is a consumer, nothing in these Terms & Conditions prevents the Customer from relying on mandatory consumer protection rights that apply to them.
